Abstract

Based on the analysis of three documents (two legal sentences: the first one, about the case called los “Porkys”, and a second one, about the case “Atenco”, in addition to a Special Report, emitted by the National Commission of Human Rights), it is intented to show that the way the Mexican State operates through its penal system, as a gender discriminating technology, (re)creating argumentative interjections and violent techniques of gender assertion, as well as normalized sexual practices.
The first sentence makes evident the way in which the judicial interpretations express, reinforce and reproduce normalized conceptions of gender and sexuality. The second sentence shows the way in which the punitive agents use sexual violence to penalize the bodies, of women in this case, to reassert the established gender order. Finally, the third document is analyzed in order to (re)affirm that prison, as the last instance of the penal system, reinforces its functions of gender technology, through the established conception of punishment.
